Key Credit Union Field of Membership Case Appeal Underway

We monitored with interest this week’s oral arguments in an appeal of a ruling in a case challenging an expansion of the National Credit Union Association’s field of membership rule for federal credit unions. In 2016, the NCUA instituted a rule dramatically expanding its definition of a well-defined community that allows expanded membership eligibility for credit union customers. The rule in question included rural districts of up to 1 million people and portions of combined statistical areas of up to 2.5 million people as a well-defined community. And the rule would allow credit unions to serve core-based statistical areas without serving the urban core that defines the area. The ABA filed a lawsuit, supported by GBA and other major national and state industry groups, saying the rule violated federal law. ABA and NCUA each are appealing portions of the original ruling. Farm Loan Limits Increased

The USDA’s Farm Service Agency announced increases to the amounts producers can borrow through direct and guaranteed FSA lending programs. The Guaranteed Operating Loan limit increased from $1.429 million to $1.75 million. The increase in guaranteed loan limits and other lending programs are the result of the 2018 Farm Bill. Security Conference Debrief

During what was described by one attendee as the "best ever" GBA Bank Security Conference, a big crowd of security pros last week filled up notepads with tons of practical advice, trend data and best practices to help strengthen their security programs back home. Georgia Growth Highlighted in New Census Data

It’s probably not a surprise that metro-Atlanta is among the leading areas for population growth in recent years, but new census data also shows other areas in the state are among the nation’s fastest growing. Jackson County was the 10th fastest growing county by percentage in the country from 2017 to 2018, adding about 2,700 people. And, Forsyth County was the 9th fastest growing since 2000, adding some 61,000 people. Atlanta was the 4th fastest-growing city from 2017-2018, adding 75,000 more people. The metro area’s population is now almost 6 million, and it is the 9th largest metro area in the country. Details here.

Modest Economic Improvement Cited by Fed Report

Increased home sales, commercial real estate strength, a boost in manufacturing orders and steady banking conditions highlighted economic activity in the Federal Reserve’s Sixth District in March and early April. The Federal Reserve’s Beige Book Summary for the region categorized growth as modestly improved, and expectations for the next few months are that similar conditions will persist. In banking, asset quality remained strong, earnings improved and lending was stable. Bankers noted some decline in demand for consumer borrowing. Ag conditions were mixed. In late-March, weekly cash prices were up for corn and beef, while cotton, rice, soybean, broiler and egg prices were down from a year ago. Details for the region are here.

Annual Meeting Closing Speaker Will Challenge You to Change the Way You See

Warren Macdonald’s survival story began in April 1997 with his accident on North Queensland’s (Australia) Hinchinbrook Island. Climbing to the Island’s tallest peak, he became trapped beneath a one-ton boulder in a freak rock fall. Two days later he was rescued, only to undergo the amputation of both legs at mid-thigh. Just ten months later, he climbed Tasmania’s Cradle Mountain using a modified wheelchair and the seat of his pants. In 2003, he became the first double above-knee amputee to reach the summit of Africa’s tallest peak, Mt. Kilimanjaro (19,222 ft). Later that same year, in a spectacular effort requiring more than 2,800 pull-ups over four days, he climbed America's tallest cliff face, El Capitan. Macdonald is also the only above knee amputee to make an ascent of Canada’s landmark frozen waterfall, the 600-foot Weeping Wall in Alberta. Webinar: New Federal Overtime Regulations – What You Need to Know

On May 7, Steve Greene, of GBA Strategic Partner ELC, will be presenting a webinar specifically addressing recent technical changes to federal overtime payment obligations. The session will feature coverage of the proposed overtime exemption regulations, how to assess and implement those changes and insight concerning the likely timetable for those changes. Greene will examine changes, which result from the proposed regulations governing "regular rate" issues released by the Department of Labor on March 28. Greene will also address developments regarding the exempt status of mortgage lenders, consumer lenders and related positions, including new opinion letters issued by the Wage and Hour Division, including one which addresses whether time spent by nonexempt personnel performing community events must be considered "hours worked." Attendees will receive detailed self-audit checklists for their organizations to assess exemption status, taking into account the new salary and compensation levels and current interpretations of the various exemption "duties" tests.
