SB 157 Shared Deposit Implementation on Track

A third and what we expect to be the final in-person meeting was held this week with State Treasurer Lynne Riley and the stakeholders involved in implementing SB 157, the shared deposit legislation related to public depositor accounts passed during this year’s legislative session. As a reminder, the bill expands to public depositor transaction accounts the current authority to use shared deposits programs with time deposits, like CDARS, to avoid collateralization. GBA’s Joe Brannen and David Oliver are on the implementation team that has been reviewing various drafts to present to the State Depository Board. Read more about the implementation status here.

GBA Urges More Credit Union Oversight

This week GBA joined bankers associations from every state and Puerto Rico in calling on Congress to beef up its oversight of the tax-exempt credit union industry and the NCUA. Our joint letter to members of the House and Senate tax-writing committees, along with the Chairmen and Ranking Members of the House Financial Services Committee and Senate Banking Committee, points out some serious concerns. State of Georgia Argues Against CFPB’s Single Director Structure

Georgia, as represented by Attorney General Chris Carr, is among several states signed on to an amicus brief in a case before the U.S. Supreme Court arguing that the CFPB’s single-director structure violates the separation of powers required by Article II of the U.S. Constitution. Read more about the case here. Other states party to the brief are Texas, Arkansas, Indiana, Kansas, Louisiana, Nebraska, Oklahoma, South Carolina, Tennessee, Utah and West Virginia.

Perdue Pushing for Faster Reg Reform Implementation

Georgia Sen. David Perdue is among 13 Republicans from the Senate Banking Committee that want regulators to pick up the pace of implementing reforms required by S. 2155, which was signed into law in 2018. The Senators want to see the Community Bank Leverage ratio set at 8%, faster implementation of the short-form call report and other measures. They also implore agencies to help banks during the coming CECL transition and more. We appreciate Sen. Perdue’s work to speed up the reforms. Read their letter to regulators here.

Be Aware of East Georgia Wire Fraud Scam

This week we heard from a member community bank CEO in a fairly rural market in east Georgia. He wanted us to let members know about a scam going on in his community involving an elaborate spoof and information stolen from the county’s computer system. Read the full story here, and remember to be aware that fraudsters are getting more clever and bolder all the time.

HMDA Rulemaking Comment Period Re-opened

The CFPB has re-opened the comment period for some parts of its proposed rulemaking of Regulation C, which implements the Home Mortgage Disclosure Act. The bureau is looking for additional comments about proposed changes for the coverage threshold for closed-end mortgage loans, proposed changes to the permanent coverage threshold for open-end lines of credit, and the appropriate effective date for any change to the closed-end coverage threshold. Comments must be received by Oct 15. The notice announcing the reopening of the comment period is available here.

How BankWork$ Is Preparing New Banker Talent

Earlier this year, GBA endorsed the BankWork$ banker training program being provided by the Urban League of Greater Atlanta. The eight-week program prepares candidates for front-line jobs at banks, and it has been a big success since it started in March 2018. To date, 87 people have entered the program with 65 graduating. At least 26 graduates have been hired by partner institutions including Bank of America and Citizens Trust Bank, both of which have made multiple hires from the program. The list of hiring institutions also includes BB&T, Fifth Third Bank, PNC, Regions Bank, SunTrust, Wells Fargo and Woodforest Bank. Read more about the program here. State Hemp Rules Comment Period Open

The state has issued its proposed rules for hemp farming, as allowed for by legislation signed into law this year. The comment period on the rules runs until Aug. 12. The basic rules will require growers to pay an annual fee for a license of $50 per acre, up to a $5,000 maximum. A permit to process and make hemp products would cost $25,000 up front and $10,000 annually. Applications may be made when the U.S. Department of Agriculture approves the program. The Georgians First Commission was created by Gov. Brian Kemp to review state regulations, policies, and procedures to streamline government, remove inefficiencies, and secure Georgia's place as the top state for small business in the country. A number of working groups are being appointed, and GBA’s chairman Chuck Copeland, president and CEO of First National Bank of Griffin, as well as GBA president and CEO Joe Brannen are serving on two of the Task Forces.
