GBA’s Canadian Invasion Imminent

More than 350 bankers, Associate Members and family members will be attending the 2019 GBA Annual Meeting in Banff, Canada, starting Sunday. Bags are packed, passports are secured and all the details are set for what promises to be an amazing event. Our program includes the latest intel on the economy, peer CEO best practices, leadership strategies, technology updates, the state of the association address by GBA Chairman John Hall, American Pride Bank, and an inspiring story of adventure and perseverance. Most Georgia-Based Banks Eligible for Streamlined Call Report

Regulators this week adopted a final rule making more banks eligible for a shorter version of the Call Report. The rule applies to non-complex banks with less than $5 billion in total assets, which means all but five Georgia-based banks will likely qualify to file the most streamlined version. Banks filing the FFIEC 051 Call Report will also see a reduction of the number of data items required in their first- and third-quarter filings. Advantages and Disadvantages of Bank Holding Company Structure

Over the years many of our members have formed bank holding companies to take advantage of certain additional permitted activities and other practical benefits. More recently, some banks have ditched the bank holding company structure as it no longer met their needs. GBA’s associate member Troutman Sanders recently published a list of the advantages and disadvantages of a bank holding company structure, and our thanks to James Stevens tor allowing us to share the list with all our members. Building Work Ethic, Earning Your CRCM and Collecting Antiques with Angela Woodard

Angela Woodard, deposit compliance officer at SunMark Community Bank in Hawkinsville, started helping her dad in his clothing store when she was 12 years old, sweeping floors and emptying trash cans to work her way up. She had to earn his trust, doing progressively more challenging work until by age 16 she was able to open the store on Saturday mornings. "Until I learned and mastered whatever job he gave me, I couldn’t move on to the next one. I learned a lot in those first few years about hard work, how to earn my way up through the ranks and the importance of a strong work ethic," she says. A graduate of the GBA Basic and Advanced Compliance schools, At Large member of the GBA Compliance Committee and recent CRCM designee, Woodard says GBA training was instrumental in helping her pass her CRCM exam. She talks about the joy of cultivating relationships over the years with her "bank family," her hobby of collecting antique cameras and the career journey that led her to the area of bank compliance in the latest GBA Member Profile.

Overdraft Issues Get FDIC Supervisory Spotlight

Overdraft disclosure issues are one of the key items noted in the inaugural edition of the FDIC’s Consumer Compliance Summary Highlights. The publication summarizes findings from about 1,200 FDIC consumer compliance exams in 2018. Related to overdraft disclosures, FDIC said disclosure issues can crop up when processing systems use an "available balance" method to assess overdraft fees. Other issues noted included certain RESPA violations and finance charges and disclosures on lines of credit. Access the Supervisory Highlights publication here.

Agencies Release List of Distressed or Underserved Geographies

The Board of Governors of the Federal Reserve System, FDIC and the OCC Monday released their 2019 list of distressed or underserved nonmetropolitan middle-income geographies, where revitalization or stabilization activities are eligible to receive Community Reinvestment Act (CRA) consideration. Available on the Federal Financial Institutions Examination Council (FFIEC) website, the criteria for designating these areas reflect local economic conditions, including unemployment, poverty and population changes. You can access the nationwide list here, and Georgia’s geographies can be found on pages 18-25.

BofA’s Moynihan on Technology, Branches and Level Playing Fields

We saw a recent article in Fortune from an interview with Bank of America CEO Brian Moynihan. While the vast majority of our members have neither the scale nor budget the size of Moynihan’s, it was interesting to learn that 75% of the bank’s deposits are now made electronically, yet branch traffic remains high. Moynihan also talks about the growing threat from non-bank providers of traditional banking products and the need for a level regulatory playing field among all participants in the marketplace. IRA Advanced Update and Review Workshop, Sept. 12

The IRA Advanced Update and Review Workshop will take place on Sept. 12 at Middle Georgia State University in Macon and Patrice Konarik, president of Sunwest Training Corp., will speak on recent changes as she covers content at the intermediate-to-advanced level. Each participant will receive the complete 275-page Sunwest Training IRA Training and Reference Manual, which is updated to reflect new regulations. Panel: BSA Regulatory Consent Orders & Lessons Learned

BSA consent orders have been on the risk based on regulatory findings over the past several years and lessons learned from these orders. Financial institutions that have never been met with a consent order find themselves in a vulnerable position during regulatory exams as areas of BSA that may have been acceptable in the past are now a deficiency. The panelists (Jesse Morton, Stout Consulting, CPA/CFF, CFE, CACTS, J.D., LL.M., Director of Dispute Consulting; Jay Funderburke, BSA Officer, PeoplesSouth Bank; Michael Musgrave, CAMS, BSA Officer, Senior Vice President, Rabobank, N.A., and David Chaiken, Partner, Troutman Sanders) will take attendees through a real-life case study of a consent order that lasted two years including how the Bank got in the position, how they worked their way out of the consent and lessons learned. In addition, this session will feature a financial institution in Georgia that recently went through a BSA consent, lessons learned, and how this order has significantly changed their BSA program.
