Electronic Signatures OK for MV-1 Forms

Our thanks to the Georgia Department of Revenue for clarifying the signature requirements for motor vehicle tag and title application forms (MV-1 forms). In a memo to GBA, the department said that electronic signatures on MV-1 forms are acceptable. Many banks are moving to more electronic loan documentation systems, and the official rules were unclear as to whether electronic signatures were acceptable on documents as opposed to an original signature. GBA sought clarification from the Department of Revenue at the request of a member bank. Here’s a link to the official memo that gives the OK for electronic signatures. Tailored Regulation Push Letter Sent

U.S. House members this week sent the official letter to regulators we told you about a couple of weeks ago pushing them for more tailored regulation for banks. Georgia’s David Scott (D-GA13) was one of the leaders on crafting the letter and recruiting a bipartisan group of signers. Also signing from the Georgia delegation were Reps. Sanford Bishop (D-GA 2), Barry Loudermilk (R-GA 11) and Tom Price (R-GA 6). A total of 133 representatives signed the letter. Click here for more details about the tailored regulaton effort...

Drone Deposit Capture in Development

Mobile remote deposit capture based on pictures of checks has its limitations such as daily maximum deposit amounts for fraud prevention. And, sometimes customers just need to put a real check in the bank. With that in mind, some tech and logistics experts are looking to make their move into financial services by offering pickup and deposit of checks by drone aircraft. Chip-Card Terminal Upgrades at Retailers Below 50 Percent

Many retailers have yet to update their card terminals to accept smart-chip credit cards that provide added fraud protection for consumers. Some 42 percent of retailers have not made the upgrade, according to a Card Hub survey. Also, 43 percent of the retailers that experienced data breaches in the past five years have not updated their terminals. The study also shows retailers and banks have work to do to further educate consumers about chip cards. About four in 10 say they don’t have or don’t know if they have a smart-chip card, and 62 percent don’t understand the difference between major card security standards.

CFPB Updates Online Guides for Rural/Underserved Provisions

Banks can now access updates to the CFPB’s compliance guides that are in alignment with the expanded eligibility for the special provisions allowing certain small creditors to issue balloon-payment qualified mortgages and balloon-payment high cost mortgages, and exempting them from the escrow requirement for higher-priced mortgage loans. Updates have been made to the compliance guides for ATR/QM, HOEPA and the TILA Higher-Priced Mortgage Loans (HPML) Escrow Rule, the transaction coverage and exemption chart, the small creditor qualified mortgage flowchart and the ATR/QM comparison chart.
