Weather Delays State Legislative Action This Week

It's been another weather-disrupted week in many parts of Georgia. To ensure the safety of our citizens and allow the focus to be solely on efforts to deal with the ice and snow storm, Gov. Nathan Deal declared a state of emergency that's now extended through Sunday evening. The General Assembly was in session Monday and Tuesday this week, but canceled Tuesday afternoon committee meetings as well as their scheduled legislative days Wednesday and Thursday. Senate hearings on GBA's two priority bills dealing with certain bank fees, H.B. 824, and patent trolls, H.B. 809, have been rescheduled for next Tuesday. More Legislative news here...


Sub S Advocacy Action Urged by GBA

We've been in touch directly with GBA member banks that are Subchapter S Corporations asking them to weigh in on the important Basel III-related tax issue we reported about last week. The proposed Basel III capital conservation buffer prevents banks from making distributions to shareholders when capital falls below a threshold. "Our concern is that the regulators haven't given sufficient attention to the simple fact that federal tax liability passes through a Sub S bank to individual shareholders. It is patently unfair that Sub S shareholders might face tax liability even when they have not received a distribution," said GBA President and CEO Joe Brannen in a communication to Sub S bank CEOs this week. "If all 62 of the Sub S banks chartered in Georgia wrote a letter to the regulators, it would really get the regulators' attention." Banks Get High Marks for Card Security, Retailers Taken To Task

"A new report from Javelin Strategy & Research finds that financial institutions are doing a much better job than retailers when it comes to credit card security," says a recent article from CNBC. A number of GBA member banks got high marks for overall security, prevention, detection and resolution in the survey. The retailers reviewed, however, were all at the lower end of the scores, in particular for the "prevention" category. More card news here...


Consumer Awareness Efforts about Account Security Continue

News outlets continue to count on GBA as a resource for consumer protection information about account security. The Gainesville Times Feb. 6 had a story outlining consumer concerns and tips about how to protect sensitive information. The story quoted GBA's recent warning about email scams attempting to trick people into giving out their information and encouraged frequent account monitoring. "The great thing about technology is you have an ability to do that [monitor your account] in a greater way than ever before," said David Oliver, GBA SVP-Communications and Marketing. A group of some of the largest bank and retail trade organizations has announced a new cybersecurity partnership to look for ways to increase information sharing, improve card security technology and maintain the trust of customers. More card security news here...


Suggestions for Diversity Standards get
Unified Voice

Regulators are off to a good start with diversity standards proposed in October, but there are some refinements needed and cautions to consider related to vendor diversity standards and confidentiality of reports. That was the message in a joint comment letter to regulators signed by GBA, the ABA, and allied state bankers associations from around the country. More news about diversity standards here...


CFPB Seeking Input on HMDA Changes

The CFPB is considering a number of changes to Home Mortgage Disclosure Act (HMDA) reporting requirements. It is asking small lenders and other small businesses about a number of proposed changes, some mandated by the Dodd Frank Act (DFA). Changes mandated by the DFA include requiring data on the length of the loan, total points and fees, the length of any teaser or introductory interest rates; and the applicant or borrower's age and credit score. HMDA and CRA Workshop + Fair Lending - Feb. 25

This seminar features two outstanding sessions. Steve Moore of Bank Compliance Services, Avondale Estates, will be leading a full-day seminar packed with valuable information for compliance officers, loan officers and other bank personnel responsible for HMDA and Fair Lending compliance. In the morning session, attendees will learn about new and updated rules, types of loan applications that are HMDA reportable, the regulatory consequences for non-compliance, community development loans and much more. In the afternoon session, Moore will provide an-depth look at fair lending, including a detailed description of "side-by-side loan file analysis," common loan practices with potential fair lending effects, and other components of an effective Fair Lending program. Prepaid Cards from Banks a Deal says Pew Study

Consumers get a better deal when they choose reloadable prepaid cards from banks as opposed to those issued by nonbanks, according to a study from the Pew Charitable Trust. Bank-offered prepaid cards are cheaper, for one thing. For banks, the median monthly fee was $4.95 and the median acquisition fee was $4. For nonbank card providers, the median monthly fee was $6.95, with a median acquisition fee more than twice as high at $9.95. More prepaid news here...


Crime and Punishment

Robbers get 26- and 37-year Sentences

Two Georgia bank robbers have been severely sentenced for multiple armed robberies they committed in February 2013. Tony Scott Key, 45, of Albany, was sentenced to nearly 26 years in federal prison, and Anthony Jerome Facon, 48, also of Albany, was sentenced to 37 years' imprisonment. Rescheduled: IRA Basics Seminar Mar. 19

Due to inclement weather, IRA Basics was rescheduled for a later date. Keeping your safety in mind, we felt the risk was too great to continue with the seminar. However, this gives you more time to sign up to learn about IRAs from Patrice Konarik of Sunwest Training Corp. This seminar is specifically designed to teach new account representatives, certificate of deposit personnel and any officer/manager who oversees the IRA department, everything there is to know about IRAs. Included in the cost of the seminar, each attendee will receive the 225-page IRA Training and Reference Manual, otherwise known as the "IRA Survival Guide" or the "Red Book." This comprehensive workshop will provide you with a complete understanding of the IRA as well as a review of significant proposed changes.
