Wendy’s Data Breach Effects on Georgia Banks

Wendy’s last week announced a significant data breach in which credit and debit card information was compromised. Wendy’s locations in more than 30 Georgia communities were affected. We’ve heard from many members that debit or credit cards issued by their banks are among those identified as compromised, and they’ve been in the process of notifying customers and re-issuing cards to protect customers and the banks from losses. Wednesday we sent a survey to member bank CEOs to gauge the impacts of this and other retailer data breaches in the past three years. De novos Get Focus in House Committee Meeting

The drought of new bank formations since the Great Recession was one of the topics of the House Committee on Oversight and Government Reform Tuesday, as only seven de novo banks have been formed in the past five years. Georgia Rep. Buddy Carter (R-GA1, at right) questioned FDIC Chairman Martin Gruenberg on what the FDIC is doing to help new bank formation through its application process for de novos. He also expressed frustration with the regulatory environment for community banks, noting that a community bank helped him start his small business, and when he served on a community bank board before becoming a member of Congress, the only hires the bank was making was compliance officers. “Small business made America. We need your help…we need you to make it easier. We need to make sure these de novo banks, these community banks, survive. If they don’t survive, small businesses don’t survive,” he said. Georgia Supreme Court Sends Arbitration Case Back to Lower Court

We note with disappointment this week a decision by the Georgia Supreme Court to reverse the Georgia Court of Appeals and the trial judge in a case involving the validity of contracts with customer arbitration agreements. The lower courts had ruled that one member of a class couldn’t opt all members out of a proposed class. The Supreme Court disagreed. This decision in Bickerstaff v. SunTrust Bank, No. S16G1295 revives a class action lawsuit challenging SunTrust Bank’s debit card overdraft fees and a lower court will consider class certification again.

New Tailored Regulation Bill Introduced

We were pleased this week to see Sen. Mike Rounds (R-SC) introduce the TAILOR Act, which is a companion bill to the House version from Rep. Scott Tipton (R-CO) that passed the House Financial Services Committee earlier this year. These bills would require regulators to consider bank risk profiles and business models when taking regulatory actions as well as reviewing those regulations issued in the past six years and those going forward. GBA has been active in a regulatory review task force along with the ABA and other state bankers associations that was involved with crafting this legislation and having it introduced. Beige Book Notes Slight Economic Improvement

Improving home sales and prices as well as increased demand for properties in the commercial real estate sector were the highlights of the Federal Reserve’s economic overview for the Atlanta region this month. While recent activity was characterized as expanding “slightly,” businesses surveyed by the Fed said their outlook remains positive and higher growth is expected in the near term. Credit availability remained steady, deposits increased and credit quality improved, according to bank contacts. Banks also noted that small businesses were conservative with borrowing and also that compliance is increasing costs. Read the full Beige Book report here...
