Bills Affecting Banking Went into Effect July 1

July 1 is the effective date of most bills passed each year by the General Assembly including one of GBA's priority bills, H.B. 809 that adds bad-faith assertion of patent infringement to the list of violations of the Georgia Fair Business Practices Act. GBA's other priority bill, H.B. 824, ensures parity between state-chartered and nationally-chartered banks and confirms that common bank fees, like overdraft fees, will not be considered interest. That bill became effective April 15, the day Gov. Deal signed it. A whole host of other bills GBA monitored and was involved with on behalf of our members also went into effect July 1. Day Featured for Leadership, Upholding Bank's Community Ties

Cynthia Day, president and CEO of Citizens Trust Bank is the subject of a nice feature story in last week's Atlanta Business Chronicle. Day was recently named CEO of the Year by the Atlanta Business League. The article explains how Day became the CEO of the historic Atlanta bank and how her leadership style reflects the values so many in the banking industry share. "We're helping people recognize their dreams of financial independence and improve their quality of life. The marketplace in which we operate may have become more diverse, but those values haven't changed. Those principles still work," she said in the article. A friend of Day's describes her as a "nurturing leader of integrity," and someone with "a wonderful, positive energy that lifts everyone up and helps them be better." Read the full story here...


75 Georgia Counties on Distressed, Underserved Markets List for CRA

Regulators this week released the 2014 list of distressed or underserved nonmetropolitan middle-income geographies, where revitalization or stabilization activities will receive Community Reinvestment Act (CRA) consideration as "community development." There are 75 Georgia counties included in the designations this year. Here's a link to a PDF file of just the Georgia counties and designations. The current and previous years' lists can be found on the FFIEC website, along with information about the data sources used to generate those lists. Help Stop Elder Abuse with These Resources

The CFPB this week published a helpful guide to protecting older residents of long-term care facilities from financial abuse. The news release about the guide mentioned stories such as a son stealing $315,000 from his elderly mother's retirement accounts and frequenting casinos. When he didn't pay his mother's rent, she was evicted from her assisted-living facility. GBA also has a resource members can use to protect those in senior housing facilities. Investments banks make in the Senior Housing Crime Prevention Foundation (SHCPF) go toward setting up and running Senior Crimestoppers programs in nursing homes and assisted living facilities. Banks will be Celebrating Georgia Peanut Bank Week, Oct. 18-25

Banks across Georgia will celebrate Georgia Peanut Bank Week, Oct. 18-25, 2014. During the week, banks in communities across the state saluted peanut farmers' contributions to the state and local economy. The Georgia Peanut Commission, in cooperation with the Georgia Bankers Association, promotes Georgia's official state crop by sponsoring Georgia Peanut Bank Week annually. The deadline for orders is July 30, 2014, for all Georgia banks planning to participate. This year's theme is: "Peanuts. Power You Can Bank On." Bank Secrecy Act: Basic Compliance for Bank Employees - Aug. 21

BSA compliance is always a hot topic with bank examiners, who expect that all bank employees, particularly frontline personnel, are well-trained at least annually on the various reporting and recordkeeping requirements for BSA, CIP and OFAC. One of the most popular breakout sessions at the recent GBA annual meeting was led by Karl Nelson, CEO, KPN Consulting. 2014 Annual Georgia BankPAC Golf Classic - Oct. 1

Suspected ID Thief Busted in Moultrie

Moultrie police this week arrested a man accused of stealing nearly $10,000 from Georgia and South Carolina banks in an identity theft scheme. Robert Jerry Ludwig was trying to make a large withdrawal at a Moultrie SunTrust branch by using the identity of the president of a Florida technology company. Police arrested Ludwig in SunTrust's Moultrie Walmart branch and confiscated a fake ID and fake Florida Driver's license. Ludwig is probably not working alone, according to police, who are seeking the public's help in identifying others associated with him. Read more here...and read the next story, too. Surprisingly Lax Consumer Attitudes about Privacy and Security

Almost 80 percent of consumers in one recent survey said they had not taken any action after hearing of the Target breach to protect their privacy or to prevent credit/debit card fraudulent activity, reports a blog post from the Federal Reserve Bank of Atlanta. The May 2014 research study by idRADAR had some other surprising findings, too. More than half (58 percent) admitted that they changed their personal e-mail or online passwords only when forced or prompted to do so. And, fewer than 10 percent changed it monthly, the blog post said. A takeaway is that banks and others can help by providing ongoing education to consumers about the importance of good data security habits, while also touting the lengths they go to in protecting sensitive data.
