Book Festival Prize Honors Judy Turner

It’s nice to see bankers recognized for their unique and significant roles in their communities. Judy Turner (at far right in the photo), who recently retired from Private Bank of Decatur, a division of Private Bank of Buckhead, helped start the AJC Decatur Book Festival in 2005 and continues to serve as the festival’s board president. So, as a fitting tribute to her 51-year career in banking and in recognition of her commitment to the festival, the bank contributed $10,000 in seed money so the AJC Decatur Book Festival could establish the Judy Turner Prize. Privacy Notice Exception Rule Proposed

The CFPB July 1 proposed a rule that would provide banks with exemptions from sending annual privacy notices to customers in certain circumstances. The rule would implement a GBA-supported amendment passed by Congress in December 2015 to the Gramm-Leach-Bliley Act. Under the proposal, a bank would be exempt from sending a privacy notice if it has not changed its policies since the last notice was sent and it does not share non-public personal information with third parties, unless required by law. Helpful Call Report Changes Approved

The FFIEC this week approved several changes to call reports that will reduce some of the reporting burden for about 92 percent of Georgia-based community banks. The changes apply to banks under $1 billion in total assets. Call report changes in five schedules take effect Sept. 30 of this year, as do increases in existing reporting thresholds and the establishment of a new threshold for certain data items in six call report schedules. Brokered Deposit FAQ Updated

The FDIC has updated its frequently asked questions (FAQ) document about brokered deposits. In essence, the answers in the document outline that the FDIC’s views are that most deposits involving a third party will be considered brokered. The agency did say it will consider determinations about the brokered-status of some deposits on a case-by-case basis because it “recognizes that brokered deposit determinations are fact-specific.” Bankers with questions are encouraged to contact their local FDIC offices and the agency said banks that need to reclassify deposits as brokered would generally not need to refile past Call Reports.

SWIFT Compromises Highlight Need for Cyber Defenses

High-profile cyber-attacks on an international communications and payment network shine a bright light on the need for all banks to review, assess and strengthen data security protocols where needed. A broad coalition of industry and security groups has issued a statement with incident details and risk-mitigation steps to take in the wake of recent compromised communications sent through the SWIFT communications network. Overseas banks have been affected, with losses estimated at around $81 million thus far. More cyber security news here...

Bid Rigging, Bank Fraud Draw Guilty Pleas from Three Real Estate Investors

Jeffrey Wayne Brock, David Wallace “Chuck” Doughty, and Stanley Ralph Sullivan pleaded guilty recently to rigging auctions of foreclosed Cobb County homes from June 2007 to January 2012. Court documents say the three Georgia men and their co-conspirators agreed not to compete for the purchase of selected foreclosed homes so that they could win the auctions for those homes with artificially low bids. The winning bidders then made payoffs to conspirators who had refrained from bidding against them. As a result, conspirators profited from money that otherwise would have gone to mortgage holders and other secured debt holders, and in some cases, to the owners of foreclosed homes. The FBI, federal prosecutors and the Justice department have an ongoing focus on foreclosure auction fraud. To date 18 of 20 defendants charged with crimes related to foreclosure auctions have either pleaded guilty or agreed to plead guilty. Read more here...
