Overtime Exemption Rule Advocacy Urged

We encourage member bankers to write Congress to support a bill that would slow implementation of the Department of Labor’s (DoL) overtime exemption rule. The Protecting Workplace Advancement and Opportunity Act -- introduced in the House as H.R. 4773 and the Senate as S. 2702 -- would require the DoL to examine fully the rule’s impact on small businesses before it takes effect. All bankers can use the ABA grassroots advocacy tool to easily send a customized letter to your members of congress. Durbin Repeal Bill Gets GBA, Nationwide Banker Support

GBA, the ABA and the other state bankers associations this week wrote to the U.S. House Financial Services Committee, urging members to support H.R. 5496, introduced by Rep. Randy Neugebauer (R-TX) to repeal the interchange fee price controls imposed by the Durbin amendment. We understand from the ABA that members of the committee and staff say it is vital to hear the industry’s support of the Neugebauer legislation and committee chairman Jeb Hensarling’s (R-TX) concurrent efforts to have this language removed. Hensarling is expected to file his significant Dodd-Frank overhaul legislation that includes repeal of the Durbin Amendment soon. GBA, Others Urge Action on Rural Appraiser Shortage

GBA joined other state bankers associations nationwide and the ABA this week in seeking quick action to curb a shortage of qualified appraisers in rural areas. In a letter to federal regulators and the Appraisal Qualifications Board, the associations called for creative and bold reforms to the criteria necessary for qualifying as an appraiser. “The shortage of qualified rural appraisers has dramatically increased the time to process a rural real estate loan,” the associations said in the letter. “This has created a detrimental ripple effect throughout rural economies in this country because all affected parties, the bank, the seller and the buyer, must remain at a standstill until a qualified appraisal is available to service a loan transaction.” With questions, contact Joe Brannen, 404.420.2026, or Elizabeth Chandler, 404.420.2027.

DBF Crosses the T on Code Review Task Force Work

Final rules released this week by the Department of Banking and Finance included provisions from its annual housekeeping bill that were the result of the public-private Code Review Task Force coordinated by GBA. The task force is meeting in August to consider changes for the 2017 legislative session. Brad Miller, United Community Bank, Blairsville, chairs the task force, which is made up of members of the GBA’s Bank Counsel Section and senior department staff with Deputy Commissioner for Legal and Consumer Affairs, Bo Fears, serving as scrivener. Credit Committee Talks Traffic, Talent, Training and More

GBA’s Credit Committee, led by 2016-2017 Chair David Caswell, Century Bank of Georgia, met this week to discuss industry lending and underwriting trends, as well as to begin planning the 2016 GBA Credit Conference it sponsors. The committee discussed how e-commerce and other alternative delivery channels for all types of businesses are affecting the economy and lending opportunities. Consumers’ growing preference for shopping online, for example, is heavily affecting walk-up retail businesses and the corresponding opportunities for banking those businesses. It’s even an infrastructure issue in metro markets as people look to online transaction and service channels to avoid heavy traffic. Look for details soon about the conference agenda and speakers. The date of this year’s conference is Dec. 15-16 in Atlanta.

Compliance Peer Group Meeting Wrap-up

A big crowd of Compliance professionals from banks across Georgia came together Tuesday at the GBA Compliance Peer Group Meeting. Tuesday’s program focused on third-party provider management, with information covering the risk management side and the compliance side. The morning started off with Ken Proctor, Cadre-Strategic Risk Management, LLC, Atlanta, Tom Hinkel, Safe Systems, Alpharetta speaking. After lunch, Tony Womack and Liz Redding Hogan with the FDIC, Atlanta, joined the morning speakers for a panel discussion. The GBA Compliance Peer Group is sponsored by the GBA Compliance Committee, chaired by Jim Bedsole, BankSouth, Greensboro.

CECL Guidance Issued by Regulators

Last Friday, bank regulators issued guidance to implement FASB’s new loan loss accounting standard, which uses the current expected credit loss (CECL) standard. The guidance outlines how the new standard differs from current accounting principles in the United States, as well as general expectations about data collection systems, forecasting and portfolio segmentation. The guidance also explains how the agencies will apply the new standard to different classes of assets at the effective dates of 2020 and 2021 and outlined steps to take to remain in compliance as CECL is implemented. Walmart Pay Comes to Georgia

Retail giant Walmart says customers at its 180 Georgia stores are among the first in the nation to have access to its new mobile payment application on smartphones. Walmart Pay works with stored credit, debit or Walmart gift cards on any iOS or Android device through the Walmart apps for each operating system. The company says that more than 20 million customers use its app each month. Walmart announced the launch of its mobile payment options in December. Merchant Customer Exchange (MCX), a consortium that had the backing of Walmart, that was working on its own merchant payment system, CurrentC, to compete with other mobile payment networks announced in May it was shelving plans for that system, which would have put bank and card-issuer interchange revenues at risk.
