Gov. Deal Signs Priority Director and Officer Protection Bill

On Tuesday Gov. Nathan Deal signed into law H.B. 192 that provides critical liability protections for bank directors and officers by modernizing the state’s business judgment rule. We appreciate the Governor’s signature on the law, and also want to again thank Rep. Beth Beskin (R-Atlanta) for sponsoring the legislation and Sen. John Kennedy (R-Macon) for handling the bill in the Senate. The bill puts Georgia law on par with all other states in that the standard for liability of directors and officers in lawsuits about loan underwriting is gross negligence in both the decision-making process and the decision to underwrite the loan itself. This was one of two priority bills for GBA in the 2017 General Assembly session. Both passed and have been signed by the Governor. Message Delivered in D.C. about Need for Regulatory Relief

GBA member bankers spoke with a unified voice this week during visits to regulators and Congressional staff members in Washington, D.C. The message was loud and clear – the time is right for relief from the avalanche of regulations put in place for banks after the 2009 recession and financial crisis. Our team of bankers had regulatory briefings with the OCC, CFPB, FDIC, Federal Reserve and FinCEN. We also met with key staff members of the House Ways and Means Committee, Sens. Johnny Isakson and David Perdue, and Reps. David Scott and Barry Loudermilk. And, we had legislative and economic briefings from the American Bankers Association staff. "There really seemed to be a different mood in our meetings this year,” said GBA Chairman Rick Drews, CEO, Century Bank of Georgia, Cartersville. “There was more obvious interest in our concerns about the impact and cost of the compliance burden, and a clear acknowledgement of the role of community banks in economic expansion. Although her desire to become a teacher at a young age didn’t unfold the way she imagined, Margaret Whieldon felt fortunate to learn that she possessed the skills and frame of mind to become very successful as a bank marketer. Georgia Bankers’ Input Needed on 2017 National Bank Survey

State bank supervisors in coordination with the Federal Reserve are planning the fifth-annual Community Banking in the 21st Century research and policy conference in St. Louis, MO. The goal of the conference is to provide a venue for and encourage research on community banking. The 2017 National Bank Survey conducted as part of preparation for this year’s conference is now available at and takes about 20 minutes to complete. The purpose of the survey is to give researchers and policy makers an opportunity to hear directly from community banks on a range of important topics. The Georgia Department of Banking & Finance strongly encourages Georgia bankers to participate in the survey and provide feedback on the many important issues facing Georgia banks. CFPB Looks to Gather Small Business Lending Data

There are more than 27 million small businesses nationwide, and the CFPB this week announced a project to learn more about the financing needs of those businesses. The bureau says small businesses typically need access to credit to take advantage of growth opportunities, yet public information on this lending market is inconsistent and incomplete. The Request for Information asks for public feedback to help the bureau better understand how to bridge this information gap. Citing a Dodd-Frank mandate to collect information about small business lending to women-and minority owned businesses, the bureau wants to learn about the following things…

401(k) Education Sessions Beneficial to Trust Members

We were pleased with the great turnout of bank CEOs, CFOs and HR representatives who attended our 401(k) sessions in Macon and Atlanta last week. GBA Retirement Services (GBARS) provides free annual training seminars each year for HR representatives with retirement plans in the GBA Master Trust. In addition, members of each plan’s administrative committee are invited to attend the annual Fiduciary Training Webinar. This year, the on-site fiduciary training focused on participant outcomes in 401(k) plans and how to ensure participants can retire comfortably.
