Uptick in ADA Complaints about Websites

We understand that there has been a spike in complaints, demand letters and lawsuits nationwide questioning whether banks’ websites and ATMs adequately meet accessibility standards for visually impaired customers set by the Americans with Disabilities Act (ADA). GBA Associate Member Bryan Cave, LLP has put together a resource that lists generally accepted recommendations for website accessibility and federal ADA standards for ATM accessibility to help you review how your bank stands. Here’s a link to the resource. We’ve heard from attorneys representing two of our members who received demand letters. If your bank has gotten a recent complaint or demand letter about this, we’d like to know so we can monitor how prevalent this may be in Georgia. More Text Message Scams Reported

Emanuel and Johnson county sheriffs' offices this week issued alerts about fraudulent text messages intended to trick customers of banks with the word “Citizens” in their name (CITIZENS-BNK is the wording we’ve seen). This looks like the same scam we told you about last week affecting The Citizens Bank of Americus because of texts sent out in Crisp and Sumter counties. We sent an additional email alert this week about the scam to member CEOs of all Georgia banks with “Citizens” in their names. A couple of those banks reported small numbers of customers affected and that they’d taken protective actions. More about the text scam here...

CFPB Structure Ruled Unconstitutional

The U.S. Court of Appeals for the District of Columbia Circuit this week ruled that the CFPB’s leadership structure is unconstitutional. It took particular issue with the fact that the CFPB director position, which has a five-year term, could not be removed at will by the president. It said the bureau will continue to operate, but ordered an amendment to its structure to allow its director to be removed not just “for cause” but at the president’s discretion. 40th Peanut Bank Week Starts Monday

A number of our members will be celebrating and promoting Georgia peanuts next week. It’s the 40th edition of Georgia Peanut Bank Week co-sponsored by GBA and the Georgia Peanut Commission. Georgia growers produce about 45 percent of the nation’s peanut crop each year. Peanuts, recipe cards and other promotional material will be available during the week of Oct. 17-21 at participating financial institutions.
