The news of an investigation into a possible large data breach at Home Depot is sure to generate some concern and questions from bank customers about how banks protect customer accounts tied to debit cards or credit card accounts. For customers, the important thing to know is they are not liable for any fraudulent charges. Merchants are also quick to point this out, and that's good. But what always goes unsaid by them is that banks and card issuers bear most of the cost of making customers whole for account fraud, not the merchants. Proposed New FHLB Membership Rules Raise Concerns

The Federal Housing Finance Authority (FHFA) has sent a proposed rule to the Federal Register that would affect FHLBank membership requirements. The proposal would establish a new quantitative one percent mortgage test for all FHLBank members on an ongoing basis and would require those members subject to the 10 percent residential mortgage loan requirement to adhere to this requirement on an ongoing basis. The 10 percent component is a change because members must currently meet the 10 percent threshold only upon joining a FHLBank. GBA, on behalf of its members, requested that the FHFA extend the original 60-day comment period by an additional 60 days to allow adequate analysis and comment on the proposal. Democracy Days Go Vote Campaign Kicks Off

Bankers are encouraged to participate in a GBA campaign to get out the vote from bankers and their customers. GBA's Democracy Days campaign provides banks with a kit of materials to encourage bankers and customers to register to vote and vote in the fall elections. "It was an easy decision for Liberty First Bank to participate in this program. Our name represents those liberties we all desire!" said Liberty First Bank CEO Dawn Griffin, whose bank was the first to sign up online to participate. Bankruptcy Court Rules in Favor of Trust Preferred Holders

We have received a number of questions from our members about the involuntary bankruptcy proceeding brought against FMB Bancshares, Inc., Lakeland, by holders of its trust preferred securities. On Aug. 29, the U.S. Bankruptcy Court denied FMB's motion to dismiss the bankruptcy petition, meaning that the bankruptcy of the holding company will go forward. Fair Lending Seminar - Sept. 30

Examiners have a "renewed" interest in fair lending compliance, particularly for HMDA-reporting community banks. Banks are expected to implement fair lending compliance activities, including monitoring of lending policies, procedures, and practices, loan personnel training, and "second reviews" of denied applications. Steve Moore, president of Bank Compliance Services, will provide an in-depth look at fair lending, including a detailed description of "side-by-side loan file analysis," common loan practices with potential fair lending effects, and other components of an effective fair lending program. Fed Beige Book Outlook

Higher Economic Growth Expected for Remainder of Year, QM Rule Cited for Lending Slowdown

Positive auto, travel and tourism and housing reports highlight the Federal Reserve's Beige Book economic overview for its Sixth District from July to mid-August.
