Two-Pronged Advocacy Against Durbin Card Routing Bill

GBA this week voiced strong opposition to the bill in the U.S. Congress to create new credit card routing mandates. In a joint letter to Georgia Senators Ossoff and Warnock, GBA, CBA of Georgia and the Georgia Credit Union Affiliates outlined the potential pitfalls of the bill. We noted how the proposed legislation would increase cost and complexity for financial institutions, erode security for consumers and not reduce costs passed on to consumers by merchants. “There’s no evidence those merchants have passed on savings as promised for changes mandated for debit card routing by prior legislation, and consumers are, in fact, harmed by reduced network quality, reduced consumer protections, and reduced security,” the letters to our senators say. In another letter opposing the legislation by GBA and state banking associations from around the country to U.S. House and Senate leadership, we define how the bill will result in “fewer options for consumers, greater threats to consumer data and privacy, weakened community banks and credit unions, and the disappearance of card rewards programs that families of all income levels use to stretch their budgets.” Read the joint associations’ letter here. GBA Bank Accountant Board

Bank Accountant Section Board Meets

Our volunteer board of bank accounting pros met last week for a check in and program planning. The GBA Bank Accountant Board, chaired by Doug Mims of Carr, Riggs & Ingram, reviewed key accounting trends for banks and mapped out the agenda for the 2022 GBA Bank Accountant Conference coming up Sept. 25-27. Among the topics discussed were full CECL implementation taking effect Jan. 1, the request by regulators for comment on an updated policy statement about accommodations and workouts for commercial real estate loans to borrowers experiencing financial difficulty, and counseling clients on eligibility for employee retention tax credits. The conference will feature its annual roundtable session of all things bank accounting as well as time to join the general sessions of the GBA President/CEO and Bank Counsel conferences that will also be in session. The Bank Accountant Conference is open to member bank accounting professionals and partners and associates working for Associate Member accounting firms. We’re headed back to campus this fall for the return of the South Georgia Community Bank Symposium. The event, co-hosted by GBA and Valdosta State University’s Harley Langdale Jr. College of Business Administration, will be Oct. 13, from 10 a.m. – 2:30 p.m. at the Valdosta State University Student Union building. Compliance Alliance Question of the Week


Question: When an institution changes their privacy notice to cease sharing nonpublic personal information with nonaffiliates, does this trigger a mailing to all customers?


Answer: No, this will not trigger a revised privacy notice. A revised notice is required when you want to disclose any nonpublic personal information about a consumer to a nonaffiliated third party in a way that was not described in the initial privacy notice. If you make a decision to change your sharing in a way that limits what you share then a revised notice is not necessary. There is a belief in the industry that every change to your privacy policies will trigger a revised notice but a notice is only prompted by a sharing of nonpublic personal information that is outside the boundaries of what was previously disclosed.
