Bank Counsel Board Meets

GBA’s volunteer Bank Counsel Section Board of bank legal experts gathered this week to share information on legal trends and plan their upcoming conference. The meeting featured updates about possible upcoming legislation related to Property Assessed Clean Energy (PACE) loans and court-suggested cleanup legislation related to security deeds in bankruptcy cases. Bo Fears of the Georgia Department of Banking and Finance shared some insight into development of the department’s annual housekeeping legislation, and GBA General Counsel Jonathan Hightower of Fenimore Kay Harrison LLP described the process GBA follows for considering filing Amicus briefs on behalf of the industry. “My favorite part of the meeting was hearing from Board members about key issues affecting banks,” said board Chair Melinda Davis Lux of United Community Bank. Roundtable topics included heightened regulatory scrutiny of bank M&A transactions, extended M&A regulatory approval timeframes, environmental, social and governance trends, and increased check fraud. Members also planned sessions for the Bank Counsel Conference coming up Sept. 25-27 at the Ritz-Carlton Reynolds, Lake Oconee. Details and registration info here.

NSF Guidance Issued by FDIC

Members will want to review guidance out last week from the FDIC about charging multiple NSF fees for transactions presented multiple times against insufficient funds in a customer’s account. The guidance covers a number of practices banks can follow to mitigate risks, and said it will recognize a bank’s proactive efforts to self-identify and correct violations. Read the guidance here.

'Tears and Hugs...': Helping Customers Achieve the American Dream with Jason Rooks

Jason Rooks, senior vice president and commercial lending manager at Flint Community Bank in Albany, grew up watching his dad make a huge impact on his community and customers as CEO of a local bank. “People and building relationships are why I love banking as a career,” Rooks said. In the latest GBA Member Profile, the South Group rep. on the Leadership GBA Board of Directors shares a favorite memory as a banker where he helped three brothers sell their successful restaurant to a friend and colleague, which the bank made possible through an SBA loan. “It was an emotional closing with tears and hugs for all the parties involved. Those days make you feel valued to play a small part in the American Dream for someone,” he said. 2022 Georgia Banking Compensation Survey Available

The results of the 2022 Georgia Banking Compensation Survey have been published and are available for members to order. The results can help your bank develop a comprehensive and competitive compensation package to address today’s tight labor market. This year’s survey provides data on current practices for base salaries, incentives and bonus programs as bank leadership continues to balance the needs of the bank and its customers. This year's survey report represents:

  • 58 Georgia institutions

  • Over 4,300 Georgia incumbents reported

  • 141 positions reported

  • Policies and Practices Report with data on base salary programs and incentive plans.

The survey prices are $595 for participants and $1,375 for non-participants. Our longtime survey partner, Pearl Meyer, emailed all participants with instructions for purchasing the 2022 survey results. GBA BankPAC 2022 Campaign Update

With elections coming up soon, GBA BankPAC has been busy supporting our friends who are running for election. And, important to this effort obviously is raising the dollars to support those candidates. The GBA BankPAC Board is hoping that you will participate in this effort and has made the process as easy as possible. Here are the materials needed to assist you in contributing to the StatePAC (contribution may be from your state-chartered bank or holding company if a national bank) and the FedPAC (must come from eligible individuals – directors, officers and salaried employees.) Compliance Alliance Question of the Week


Question: When we make a new loan that is to be secured by a property that already secures another loan, can we rely on an existing flood cert that is less than seven years old, or do we need a new certification? Is the certification loan specific? This is not a renewal or an extension of an existing loan.


Answer: The flood certification is property-specific, not specific to a loan. You could reuse the flood determination as long as it is less than 7 years, the flood determination was recorded on the standard flood hazard determination form, there have been no map revisions or updates since the date of the determination, and you are the same lender that requested the prior determination. Click the following link to read more: 42 USC 4104b: Standard hazard determination forms (
