Tips for Consumers in the Rare Event They Get Fouled Bills from ATM

We got an unusual media inquiry last week asking about bank policies related to ATM withdrawals that include money that is damaged. At issue was a bank ATM that dispensed cash that was covered in blue dye. The bank said it was working to investigate the issue and to support affected individuals. In sharing background to Atlanta’s WSB-TV about how banks deal with damaged money, we provided a series of tips for consumers about how banks generally work with customers and the Federal Reserve to replace and remove damaged money from circulation. Tool for New Small Business Reporting Rule Available

The CFPB has set up a new program to help banks comply with its final rule requiring collection and reporting of credit application data for small businesses. With the new tool, named SBLHelp, banks can submit questions to SBLHelp through the CFPB website and expect an answer within 24 to 48 hours during normal business hours, although some answers may take longer, according to the agency. Written and oral technical assistance will be available. We’re looking further into the details of the new rule and will begin incorporating compliance information into our programming to help banks understand the requirements. Under the final rule, a covered financial institution is defined as a financial institution that originated at least 100 “covered credit transactions” for small businesses in each of the two preceding calendar years. In addition, a “small business” is defined as one with gross revenue of $5 million or less in the last fiscal year.

Leader Updates

Georgia Jobs, SVB Hearings, VIX Index, Consumer Spending, Retirement and Wellness

Our series of regular email updates to CEOs, committee members and other key leaders continued this week. Topics included:

  • Jobs: Statewide, Jobs were up by 3,200 over the month of January and up by 135,100 (2.8%) year-over-year to 4,875,800, an all-time high. We shared this and some other insights about the labor market.

 

  • SVB Hearings: We flagged for members where to look for questions from members of the Georgia Congressional delegation during last week’s House and Senate hearings on the closures of Silicon Valley Bank and Signature Bank.

 

  • Volatility Index: We like to look at the VIX Index that tracks and reports market volatility. The latest view shows the sharp spike in volatility related to the March banking news looks to be settling down.

 

  • Consumer Spending: The Commerce Department’s Bureau of Economic Analysis was out with its report of February data showing consumer spending and income gains were cooling. 

 

  • Retirement and Wellness: We shared stats on how GBA Retirement Services’ portfolios continue to perform better than their benchmarks, and we noted how the wellness program from Sentry Health available to GBAIT members resulted in an estimated $1.7 million in claims savings to the Trust in 2022.

Data Collection for 2023 GBA Compensation Survey is Underway

In conjunction with Associate Member Pearl Meyer, we are pleased to announce that the GBA 2023 Georgia Banking Compensation Survey participation materials are now available. If your bank has been a previous survey participant, your Survey Account Manager Rhonda Snyder has emailed this year’s submission materials. Important survey deadlines are below:

Poultry Update!

Rural Development & Lending Conference - May 18-19 on St. Simons

Mike Giles, president of the Georgia Poultry Federation, will be speaking at the Rural Development & Lending Conference May 18-19 at the King & Prince, St. Simons. Compliance Alliance Questions of The Week

 

Question: We sent a notice of incompleteness to a customer and they need more time to complete one of the items. Is it permissible to provide another notice of incompleteness (NOI) to extend the current NOI deadline for a later date?

 

Answer: Yes, that is permissible. There is no restriction in Regulation B against extending the time period and sending a second NOI. Read more here. If an applicant has not responded to the NOI by the time of its expiration, then you have no further obligation under Regulation B but you could choose to extend this period and grant the applicant more time to supply your requested information.

Atlanta - BankSouth Mortgage

BankSouth Mortgage recently announced several new hires across Georgia in Q4 of 2022. Mac Cregger joined the BankSouth Mortgage team in late December as senior vice president, Retail Production and Strategic Growth. Additionally, nine new loan officers joined Georgia branches: Shaun Hannifin and Katy Nelson joined the bank’s Gwinnett branch; Rick Fantucci and Chris Philmon joined its Buckhead branch; Stuart Smith joined its Milton Branch; in Savannah, Ivy Eilerman joined the bank as VP, producing production manager along with loan officers Katie Patronis and Aaron Sharp.
